Terms of Service
These terms apply to the use of the CRM service (the “Service”) provided by Intrawebix SRL, company ID 1025600049858, registered in the Republic of Moldova (the “Provider”, “we”). By creating an account or using the Service, you accept these terms on your own behalf and on behalf of the organization you register (the “Customer”).
1. The Service
The Service is a CRM application (managing customers, sales, activities and communications) used through a web browser. The source code and infrastructure remain the Provider’s property; the Customer receives a non-exclusive, non-transferable right to use the Service for the duration of the subscription.
2. Accounts
- The information provided at registration must be accurate and kept up to date.
- Each user keeps their password and sign-in codes confidential; the Customer is responsible for actions taken from its organization’s accounts.
- The organization’s owner and administrators decide who has access and with which rights.
3. Trial, subscriptions and payments
- New organizations receive a free trial whose length is shown at registration; the platform administrator may extend it.
- After the trial, the Service is used on a paid subscription, monthly, quarterly or yearly, at the prices shown on the “Subscription” page.
- Online payments are processed by Paddle.com, our authorized reseller and Merchant of Record: Paddle issues the invoice, collects the payment and handles VAT. Companies in the Republic of Moldova can pay in lei through maib. We do not store card details.
- Prices shown exclude VAT, sales tax and other local taxes; where the law of the Customer’s country requires them, they are added at payment. The Customer is responsible for its own tax reporting.
- If the subscription expires or is not paid, data remains available read-only and for export until renewal.
- The subscription can be cancelled at any time and stays active until the end of the paid period. Refunds follow the Refund policy: in full, on request, within 14 days of payment.
4. Acceptable use
The Customer uses the Service only for lawful purposes and is responsible for how its users use it. It is prohibited to:
Communications
- send commercial messages (email, SMS, WhatsApp, Telegram, Viber, Messenger, Instagram, calls) without the recipient’s prior consent where the law requires it, or without a way to unsubscribe; the Customer follows the rules that apply to its recipients, for example the GDPR and Directive 2002/58/EC (ePrivacy) in the European Union, Law no. 506/2004 in Romania, Law no. 195/2024 in the Republic of Moldova, CAN-SPAM and the TCPA in the United States, CASL in Canada and PECR in the United Kingdom;
- circumvent the rules of the connected messaging platforms (for example WhatsApp Business policies: approved templates and the 24-hour window);
- hide the sender’s identity or present messages as coming from someone else;
- record calls without informing the other party and without a legal basis; the Customer is responsible for informing the people it calls, under the law of their country.
Data
- enter personal data without a legal basis, in particular special categories (health, beliefs, biometric data) or children’s data;
- use the Service to track, harass or threaten anyone.
Security and operation
- attempt to access accounts, data or systems without authorization, test for vulnerabilities without consent (see the Security policy), or reverse engineer the Service;
- upload malware or files that could harm other users;
- scrape data from the Service, generate excessive automated traffic or otherwise disrupt the Service;
- circumvent plan limits, or resell or rent out access without our consent.
Content and legality
- content that is illegal, deceptive or infringes the rights of others (copyright, trademarks, privacy);
- use of the Service by persons or in countries subject to international sanctions (EU, UN, US), or to evade them.
We may remove content that breaks these rules and suspend access under section 8.
5. Customer data
- Data entered into the CRM (contacts, leads, deals, messages, files) belongs to the Customer.
- For personal data in the CRM, the Customer is the controller and the Provider is the processor, processing it only to provide the Service, as described in the Privacy Policy.
- The Customer warrants that it has a legal basis for processing the data it enters (including consent where required).
- Our staff access Customer data only for support, with the organization’s explicit permission (time-limited support access), or where required by law.
6. Integrations, API and webhooks
The Service can connect to third-party services (email, Telegram, WhatsApp, Instagram, Messenger, Viber, phone systems such as Zadarma, Twilio, 3CX or Yeastar, Paddle, maib). Their use is also governed by those providers’ terms; we are not responsible for their availability.
API and webhooks. API keys and webhooks are created by the Customer’s administrators and act on behalf of the Customer’s account:
- the Customer keeps keys secure, does not publish them and revokes them immediately if exposed; it is responsible for actions taken with them;
- we may rate-limit requests and suspend a key or webhook that is abused or endangers the security or operation of the Service, notifying the Customer;
- we announce breaking changes to the API in advance, except changes required for security;
- data sent by webhooks to the Customer’s servers is, from that point, the Customer’s responsibility; webhooks are signed and the Customer verifies the signature.
7. Availability and support
We make reasonable efforts to keep the Service available and to back up data regularly, but we do not guarantee uninterrupted operation. Maintenance is announced in advance where possible. Support: [email protected].
8. Suspension and termination
- We may suspend an organization that breaches these terms, with notice, except in serious cases.
- The Customer may close its account at any time. Data can be exported (CSV) before closing. After closing, data is permanently deleted from the application within 30 days, and from backups within at most another 30 days, except data we must keep by law.
9. Liability
The Service is provided “as is”. To the extent permitted by law, the Provider’s total liability is limited to the amounts paid by the Customer in the previous 12 months; we are not liable for indirect losses (lost profits, lost opportunities).
10. Changes
We may change these terms; the new version is published in the application and users accept it at their next sign-in. If you do not agree with the changes, you may stop using the Service.
11. Governing law and contact
The Service is available to Customers in any country. These terms are governed by the laws of the Republic of Moldova, and disputes are settled amicably or, failing that, by the competent courts at the Provider’s registered office. If you use the Service as a consumer, you keep the mandatory protections of the law of your country of residence, which prevail over this clause.
The Customer is responsible for complying with the laws of its own country when using the Service (including rules on marketing, data protection and record keeping).
Contact: [email protected]. The Provider’s registered address is available on request and is recorded in the State Register of Legal Entities.
